1. This appeal arises out of the judgment of conviction and order of sentence dated 06.04.1999, passed by the Sessions Judge, Bilaspur M. P. (now in Chhattisgarh) in Criminal Case No. 138/1998, whereby the appellant stands convicted and sentenced as under: Conviction Sentence Under Section 376 (2) (g) of the Indian Penal Code Ten years R. I. And fine of Rs. 5,000/-, in default of which additional two years R.I.

2. In the instant appeal, as per report dated 05.04.2018 received from In-charge Police Station (Mahila Thana), Bilaspur, the appellantSonu @ Santosh Suryavanshi S/o Dukhiram Syryavanshi died in the year 2006 at Ramtala. The said fact is also verified by the State counsel.

3. In these circumstance, the appeal filed on behalf of accused- Sonu @ Santosh Suryavanshi stands abated and is dismissed as such.
