The applicant has preferred this bail application under Section 438 of CrPC, as he is apprehending his arrest in connection with Crime No.590/2019, registered at Police Station Mandir Hasoud, District Raipur (C.G.), for the offence punishable under Section 420 read with Section 34 of IPC.

The co-accused including the present applicant collected huge amount to the tune of Rs.9,50,000/- from different persons promising them to provide magic coin, by which they will become super rich overnight.

The regular bail application of the co-accused has already been

dismissed by the Trial Court.

Considering the manner in which the accused persons have share common intention to commit cheating, this Court is not inclined to exercise power under Section 438 of CrPC for release of the applicant on anticipatory bail. Consequently, the anticipatory bail application is dismissed.

If the applicant surrenders and applies for regular bail, the same shall be considered expeditiously.
