1. The grievance of the petitioner is that certain criminal charges were leveled against the petitioner and pursuant thereto he was suspended on 08.12.2009 and suspension was revoked on 24.11.2011. In the meanwhile, the petitioner was acquitted in criminal case pending before the Judicial Magistrate, Bijapur. It is further contended that no departmental enquiry was conducted and only on the basis of the criminal charges the petitioner was suspended. It is further stated that against such acquittal State filled an appeal that appeal too was dismissed. Now the grievance

of the petitioner is that the petitioner is entitled for annual increment in the salary but the same is not been paid to him. It is further stated that the petitioner at this movement prays to decide his representation which is lastly filed on 09.12.2019 to the District Education Officer.

Considering the submission made without any observation on the merits at this stage subject to further verification Respondent No. 3 is directed to decide the representation of the petitioner lastly filed on 09.12.2019 for grant of annual increment from time to time which otherwise the petitioner would have been entitled within a period of 90 days from the date of receipt of a copy of this order.
