1. Heard.

2. This is the second bail application. The first bail application was dismissed for want of prosecution on 28-01-2021 in MCRCA No.48 of 2021 and other connected matters.

3. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.86/2020, registered at Police Station Singhoda, District-Mahasamund (C.G.), for offence punishable under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.

4. At the relevant time, the vehicle bearing registration No. GJ 36 T 3620 traveling from Morbi, Gujarat to Ganjam, Odisha was intercepted near Khamharpali, Check post of districtMahasamund.

5. Co-accused Bharat Bhai Patni produced a special permit issued by R.T.O. Morbi (Gujarat) which was found to be forged document as R.T.O, Morba (Gujarat) informed that the permit has not been issued from their office.

6. Co-accused Bharat Bhai Patni, driver of the bus has been allowed regular bail on the ground that the permit was handed over to him by the owner of the bus i.e. the present applicant.

7. The present is an application for anticipatory bail wherein the considerations/parameters are different. The permit produced by the driver at the time of checking was different then the one submitted by this application before the Sessions Court at the time of hearing of anticipatory bail application.

8. Learned State counsel would oppose the prayer for grant of anticipatory bail.

9. Considering the nature of offence, I am not inclined to release the applicant on anticipatory bail.

10.It is accordingly dismissed, However, if the applicant surrender and apply for regular bail, the same shall be considered expeditiously.
