The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is arrested in connection with Crime No.17/2019, registered at Police Station - GRP, District Durg, (C.G.) for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

The prosecution story, in brief, is that the police of police station GRP, District Durg, acting on a tip-off, seized 8 kilogram contraband article cannabis from the possession of the applicant. Based on this, offence has been registered against the applicant. Present applicant has been taken into custody on 08.10.2019.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. He further submits that the applicant has not carried any shoulder bag and it was kept by some other person and the applicant was sitting in the waiting hall for getting his train

and all of a sudden the GRP police came there and arrested him. He also submits that the applicant is in custody since 08.10.2019, the charge sheet has been filed and there is no likelihood of his case being decided in near future. Therefore, he may be released on bail.

4.

On the other hand, learned State counsel opposes the bail application.

I have heard learned counsel for the parties and perused the case diary.
