Ms. Richa Shukla, Dy. Govt. Advocate for the State. Heard The order passed by the Chief Executive Officer, Zila Panchayat Kondagaon, is appealable under the Chhattisgarh Panchayat (Appeal & Revision) Rules, 1995.

Learned counsel for the petitioner submits that the petitioner may be allowed to withdraw this petition with liberty to file an appropriate appeal before the appellate authority.

Since the statutory appeal is provided, therefore, I am not inclined to entertain this petition under Article 226 of the Constitution of India. With the aforesaid liberty, the petition stands disposed off.

The petitioner may file an appropriate application for condonation of delay before the appropriate authority, which may be considered sympathetically.
