This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.382/2015 registered at Police Station- Kurud, District Dhamtari (C.G.) for the offence punishable under Section 20-B of NDPS Act. 2.
Case of the prosecution, in brief, is that on 09.10.2015 the police received an information that the applicant has kept the Cannabis in his house situated at village Medarka, therefore, on the basis of such information, the house was raided and 36.350 Kg of Ganja was seized from the possession of the applicant. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in this case as the house wherein the Ganja was seized was not in exclusive possession of the applicant, therefore, he may be enlarged on bail. 4.
Per contra, learned State counsel opposes the prayer for grant of bail.

I have heard learned counsel appearing for the parties and perused the case diary.

On perusal of the case diary and the documents, prima facie, it appears that from the possession of the applicant total 36.350 Kg Cannabis was recovered, therefore, I am not inclined to release the applicant on bail.
