The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 46/2015 registered in Police Station Bori Dist. Durg (C.G.) for offence punishable under section 4, 6, 10, 11 of Chhattisgarh Agriculture Cattle Preservation Act, Section 11 Animal cruelty Act & Section 66/192 of Motor Vehicle Act.

As per the prosecution case on 30/05/2015 when the police was patrolling, at that time received information that one truck loaded with animals which were being taken to the slaughter house. Thereafter, truck bearing No.C.G.04/J-5790 was seized wherein 16 buffaloes were found and one of the buffalo was dead. Therefore, the offence was registered and during interrogation it revealed that applicant has taken the truck on rent.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case, charge sheet has been filed and there is no evidence on record that at the spot applicant was present, therefore, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Taking into account facts and circumstances of the case, charge sheet having been filed, applicant is in jail since 23/09/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
