The limited grievance that the petitioner has in the present writ petition is the non-settlement of the leave encashment which the petitioner is entitled for.

According to the petitioner, the issue as to whether the Teacher working in the aided private institutions would be entitled for leave encashment or not, is no longer res integra, as it has already been decided by this Court in WPS No. 818/2016 that the Teachers of the aided private institutions would also be entitled for Leave Encashment at par with that of Government Teachers.

Given the fact that the issue stands decided, the writ petition at this juncture stands disposed of, the respondents No.2 to 4 are directed to immediately process the claim of the petitioner subject to verification of the facts, so far as the leave encashment is concerned and necessary steps be taken for the release of the same in accordance with the Rules at the earliest preferably within a period of 4 months from the date of receipt of the copy of this order. 4.

With the aforesaid observations, the present writ petition stands disposed off.
