The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 298/2015 registered in Police Station Bilaigarh Civil and Revenue District Baloda Bazar-Bhatapara (C.G.) for offence punishable under section 354, 457 of Indian Penal Code and Section 8, 10 of the Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case on 30/10/2015 the applicant entered into the house of the prosecutrix and while she was studying caught hold of her hand and thereafter pressed her chest and obscene words were said and the prosecutrix having raised alarm when the other inmates of the house came applicant fled away from the scene. 3.
Learned counsel for the applicant submits that applicant has been falsely implicated in this case and false allegations have been levelled as there has been dispute over the land was existing between the family members and the applicant. He further submits that charge sheet has
been filed, therefore, the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Taking into account facts and circumstances of the case, degree of allegation and also taking into account charge sheet has been filed, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
