(2) Learned counsel appearing for the petitioner submits that the petitioner is working as Patwari, who has been transferred from Tahsil Raigarh to Tahsil Sarangarh and mentioned in his own expenses by the impugned transfer order dated 23.10.2015 passed by respondent No.3 i.e. Deputy Collector, Raigarh, District Raigarh. He further submits that the petitioner has not been given any application for his transfer on his own expenses and, therefore, he may be permitted to make a representation before respondent No.2 i.e. Collector, Raigarh,

for redressal of his grievances and the same may be directed to be decided expeditiously.

(3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to make a representation before respondent No.2 i.e. Collector, Raigarh. If such representation is made by the petitioner before respondent No.2 within ten days from today along with copy of this order, the said authority shall decide the same on its own merit and in accordance with law preferably within a period of three weeks from the date of receipt of representation of the petitioner.

(5) For a period of five weeks, the effect and operation of the impugned transfer order dated 23.10.2015, in respect of the petitioner shall remain stayed.

(6) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
