Hon'ble Shri Justice Arvind Singh Chandel Order On Board 20/03/2020

1. Learned Counsel appearing on behalf of the applicants submits that applicant No. 2 namely, Mukul Pandey was arrested and he has already been granted regular bail by the Special Court. Therefore, he does not want to press this application with regard to applicant No. 2.

2. Accordingly, instant application is dismissed as withdrawn with respect to applicant No. 2.

3. Looking to the above, with respect to applicant No. 1 namely, Ashish Kumar Pandey, learned Counsel submits that he wants to withdraw the instant application, however, he seeks permission of this Court to file a regular bail application before the trial Court.

4. Permission granted.

5. In view of the above submission, the instant application is dismissed as withdrawn with the aforesaid liberty. However, in the event of surrender of the applicant No. 1 namely, Ashish Kumar Pandey before the trial Court and filing of the regular bail application on his behalf, trial Court is directed to decide the bail application of the applicant No.1 probably on the date of filing of bail application itself.
