The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 285/2015 registered in Police Station Kondagaon District Kondagaon for offence punishable under section 456 and 354 of Indian Penal Code.

As per the prosecution case on 12/11/2015 while the prosecutrix was at her home, the accused entered into her house and slept along with the prosecutrix while she was sleeping and when she got up raised alarm, applicant fled away and thereby tried to out rage her modesty. 3.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and because of dispute existing between the parties, such report has been made. He further submits that charge sheet has been filed and no further evidence is required, therefore, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Taking in to facts and circumstances of the case, degree of allegation, charge sheet having been filed, applicant is in jail since

14/11/2015, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
