1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No. 78 of 2015 registered at Police station Pandatarai Civil and Revenue Distt. Kabirdham (C.G) for the offences punishable under sections 498-A, 294, 494 IPC.

2. As per the prosecution case, complainant Surekha Chandravanshi was married to Yogeshwar Chandravanshi and after the marriage she was subjected to torture for demand of dowry and the applicants who were in-laws being mother in law, father in law and brother in law used to abuse and torture her and the complainant was thrown out of the house and the husband has performed another marriage.

3. Learned counsel for the applicant submits that only general

allegations have been attributed to the applicants and the charge sheet in this case has been filed and it will take some time for hearing, therefore, the applicants may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of bail.

5. Perused the case diary.

6. Taking into fact that the charge sheet in this case has been filed and general allegations have been levelled against the applicants and further considering the fact the offences are triable by the JMFC and the applicants are in jail since 17th December, 2015, I am inclined to release them on bail.

7. Accordingly, this bail petition is allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond in sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the trial Court. They shall appear before the trial Court as and when directed by the said Court.
