The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 41/2015 registered in Police Station Dhaurpur; District (Rev. & Civil) Surguja Chhattisgarh for offence punishable under section 341, 294, 506-B, 323, 307, 34 of the Indian Penal Code.

As per the prosecution case on 2/10/2015 the complainant Dinesh Gupta while was coming back from the business when he reached near the house of Ganga Gupta, at that time the applicant who was hiding himself with axe all of a sudden attacked Dinesh Gupta and assaulted by way of axe and thereby three injuries were sustained by the complainant. 3.
Learned counsel for the applicant submits that there are other coaccused who have been enlarged on bail and because of the fact that there has been raid been conducted by the forest officer, complainant was attacked. He further submits that there was no intention to kill and he submits that considering the injury the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the statement of the eye witnesses and the injury primary allegations are attributed to this applicant, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
