Sam Koshy Order On Board 07.10.2017 The report of the Jail Superintendent, Central Jail, Bilaspur shows that the sole appellant in the instant case died in the hospital during treatment on 29.01.2005. None of the family members of the appellant has come forward for further prosecuting the case.

In the light of the fact that the appellant has expired and none of the family members intends to prosecute the appeal any further, this Court is of the opinion that nothing further remains to be adjudicated upon. 3.

In view of the same, the present appeal stands dismissed as having abated.
