---- Respondent For applicant - Shri Harish Khuntiya, Advocate. For Respondent/State - Shri Neeraj Jain, G.A. Hon'ble Shri Justice Goutam Bhaduri Order 21/01/2016 1.
The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No. 92/2015 registered in Police Station Farsabahar, Dist. Jashpur for offence punishable under section 302, 302 read with Section 34, 201 of Indian Penal Code. 2.
As per the prosecution case deceased Vikendra was murdered on the ground that applicant had love affair with Vikendra which was not accepted by father of the present applicant. Consequently, applicant called the deceased to certain spot wherein he was killed. 3.
Learned counsel for the applicant submits that there is no evidence to this regard that the girl was in any way involved in such commission of the crime and further submits that applicant and the deceased were in love affair and both wanted to marry which was objected and there was no question of commission of murder and it has been done by other co-accused father and uncle of the applicant and this applicant was not involved, therefore, the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail.
5.
I have perused the document, memorandum statement of the witnesses Dinesh and Dhol Narayan and call detail which has been made. Taking into documents and evidence deceased was called at certain spot, thereafter he was assaulted and killed, therefore this court is not inclined to release the applicant on bail.
