1. This WPL has been preferred against the order passed by Labour Court, Bilaspur directing reinstatement of respondent workman without backwages.
2. One of the ground raised in the Writ Petition at paragraph 9.16 is to the effect that the Labour Court failed to appreciate the fact that the age of the respondent was already 60-62 years, therefore, the respondent was not entitled for any relief as no employer is expected to take work of daily wager who is 60-62 years old person.
3. Shri Vinod Deshmukh, learned counsel for the respondent would submit that in pursuance of the award that the respondent was reinstated and has rejoined the services and by now he must have been regularised and thereafter retired.
4. In view of the statement made by both the counsels, the Writ Petition appears to have been rendered infructuous. It is accordingly, disposed of as having become infructuous. SD/- (Prashant Kumar Mishra) Judge Ayushi
