1. This is second bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 219/2015 registered at P.S.- Nagarnar, District- Bastar (C.G.) .for the offence punishable u/s 20(b) of NDPS Act.
2. The first bail application was dismissed on 25.10.2016.
3. As per the prosecution case, on 15.12.2015 on information being received that the applicant was coming from Odisha to Jagdalpur on Maruti Echo Car bearing registration No. C.G.- 10-FA 0970 having possession of cannabis weighing about 28 kg. and he was ready to sell the same, a raid was made in which the applicant was found in possession of the said cannabis and the same was recovered from him.
4. Learned counsel for the applicant submits that there is no substantial progress in the trial and the applicant is in jail
since 15.12.2015.
5. On the other hand, learned State Counsel opposes the bail application.
6. Perused the case diary documents. Considering facts and circumstance of the case especially the quantity of cannabis i.e. 28 Kg. seized, I am not inclined to release the applicant on bail.
7. Accordingly, this application is rejected. The trial court is directed to expedite the trial.
