NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 259 of 2021 Jitendra Choudhary, S/o. Late Goduram Choudhary, aged about 44 years, R/o. Ward No. 13, Police Line Gharghoda, P/s. and Tahsil- Gharghoda, DistrictRaigarh, Chhattisgarh. ---- Petitioner

Versus

Sushil Kumar Naik, S/o. Shri D.D. Naik, aged about 33 years, SDO, Police, Dharamjaigarh, District- Raigarh, Chhattisgarh. ---- Respondent For Petitioner : Mr. Vipin Punjabi, Advocate Hon'ble Shri Justice Rajendra Chandra Singh Samant Order On Board /06/2021 1.

Present contempt petition does not disclose as to any order of this Court, regarding which, contempt has been made by the respondent. 2.

The allegation of the petitioner is this that respondent has deliberately supplied false information and made false statement in reply given in W.P.(Cr) No. 736 of 2019. False statement, suppression of facts and supply of forged documents is a matter to be enquired and determined first and without such determination, nothing can be made out whether it amounts to contempt or not. At present there does not appear to be any 'civil contempt' as defined under Section 2 (b) of Contempt of Courts Act, 1971 or 'criminal contempt' as defined under Section 2 (c) of the Act, 1971.

3.

The claim and the statement of the petitioner firstly needs an enquiry and that enquiry can not be made in the present petition. Hence, this petition appears to be devoid of substance and therefore, it is dismissed and disposed off accordingly.
