WPS No.4517 of 2009 NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 4517 of 2009
1. Shanti Bai Yadav, aged 54 years, Widow of Net Ram Yadav, 'Aaya' Bal Sanrakchhan Griha, Durg.
---- Petitioner
Versus
1. The State Govt. of C.G., through the Secretary, Mahila and Bal Vikas Sanchalanalaya, DKS Bhawan, Raipur.
2. District Karyakram Adhikari, Mahila & Bal Vikas, Durg. ---- Respondent For Petitioner Shri Vinod Shamra, Advocate For Respondent/State Ms. Fouzia Mirza, Addl. Adv. General Hon'ble Shri Prashant Kumar Mishra, J Order On Board 28/11/2019 1.
Petitioner has called in question the order dated 30-5-2009 by which her regularisation on the post of 'Aaya' (vk;k) by allowing regular pay scale in the contingency paid establishment vide order dated 30-7-2007, has been cancelled. 2.
Annexure - R/1 to the return clarifies that there is no sanction of workcharged and contingency paid establishment in the Directorate of Women & Child Developemnt, therefore, the petitioner could not have been regularised in that establishment. It is also significant that the petitioner does
WPS No.4517 of 2009 not satisfy the required educational qualification for the post of 'Aaya' (vk;k), which is the reason mentioned in the impugned order for withdrawal of the order of regularisation. 3.
At the time of filing of the writ petition, petitioner was 54 years of age. Her present age would be about 64 years, therefore, even otherwise the petitioner has already attained the age of superannuation.
4.
Since no interim relief was allowed in favour of the petitioner, the writ petition is rendered infructuous. Accordingly, the petition is dismissed as having become infructuous. 5.
No order as to cost(s).
