Hon'ble Justice Shri Gautam Chourdiya Order on Board 25/06/2021 1) The matter is heard through Video Conferencing. 2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 08/01/2021 in connection with Crime No. 07/2021 registered at Police Station Kasdol, District Balodabazar-Bhatapara (C.G.) for the offence punishable under Section 376(2)(1), 376(2)(N) & 456 of the Indian Penal Code.
3) Learned counsel for the applicant submits that offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has also been registered in the charge sheet filed by the Police and therefore she seeks to withdraw this bail application with liberty to file fresh application before concerned Special Court (SCST Act). Further she prays for return of certified copy of the impugned order. 4) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
5) Registry is directed to return certified copy of the impugned order to the Counsel for the applicant on her furnishing true authenticated xerox of the same.
