1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 346/2017 registered at Police Station Tilda Nevra, Distt. Raipur ( C.G) for the offences punishable under Sections 384 of IPC.
2. As per the prosecution case, a report was made by Smt. Palak Ranglani that one Vijay has taken 10 bracelets from the shop of her husband and having not returned the jewels, the complaint was made to police. Subsequently the threat was extended that the news will be published in the newspaper that he uses to sell the fake ornaments and the present applicant who is a reporter of newspaper also joined the hands to make such demand and amount of Rs.3 lakhs was demanded.
3. Learned counsel for the applicant submits that no seizure of bracelets has been made and only on the fake allegations, the case has been registered. She further submits that the
charge sheet has been filed, the applicant is in jail since 16.01.2018 and offence is triable by the JMFC and the allegations are completely vague, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application. .
5. Perused the case diary and the statement of complainant Palak Ranglani. Considering the fact that the applicant is in jail since 16.01.2018; charge sheet has been filed and offence is triable by the JMFC, I am inclined to allow this bail application.
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
