1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.7/2019, registered at Police Station Tilda-Nevra, District Raipur (CG) for the offence punishable under Sections 41 (1 +4) of Cr.PC, 392, 34 of IPC and Sections 25 & 27of the Arms Act.

3. As per the prosecution case, three unknown persons committed loot of Rs.700/- and one mobile set from Daya Shankar Sharma,

MCRC No. 958 of 2020 who was working as Watchman in Raipur Minerals Private Limited Company, Urla, Raipur. During investigation, co-accused Bhagat Ram and Rajkumar were arrested when they were trying to sell the looted mobile at village Sankra. Co-accused Bhagat Ram @ Ravi has already been released on bail by this Court in MCRC No7035 of 2019 on 19.12.2019.

4. Learned counsel for the State opposes the bail application.

5. Considering the fact that the offences are triable by JMFC; and the co-accused has already been released on bail by this Court, I am of the opinion that present is a fit case to release the applicant on regular bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
