1. Heard.

2. The only grievance of the petitioner is that the State vide its notification dated 22nd of September, 2008 has directed to all the departments that the persons who are working on the pay-scale of 6500-10500/- would be declared as ClassII Gazetted Officer and it is stated that the petitioner is a Lab Technician getting the salary in the pay-scale of 6625-10500, therefore, he would derive the benefit of circular to be appointed as a Gazetted Officer, however, the same is

not been done.

3. Learned counsel for the petitioner would submit that the petitioner has filed an application before the Secretary, General Administration and the same is not been decided.

4. After perusal of Annexure P-2 it is observed that the petitioner shall be at liberty to make afresh representation before the respondent No.1 Secretary, Department of Health and Family Welfare along with the copy of the circular Annexure P-2 dated 22nd September 2008 canvassing all the grievance and if such representation is filed, it shall be decided within a reasonable time.
