---- Respondent For Applicant:
Mr. Surfaraj Khan, Advocate For State:
Ms. Madhunisha Singh, P.L.
Hon'ble Shri Justice P. Sam Koshy Order on Board 15.01.2016 1.
This is third bail application filed under Section 439 of Cr.P.C. for grant of bail to the Applicant who is in jail since 21.03.2014 in connection with Crime No. 66/2014 registered at Police Station - Bishrampur, District Surajpur (C.G.) for the offence punishable under Section 460 and 302/34 of I.P.C. 2.
The first bail application was dismissed as withdrawn with liberty to revive the same after examination of the eye witnesses. After the eye witnesses were examined the Applicant filed second bail application which stood rejected on 06.04.2015 on merit taking note of the statement of the eye witnesses.
3.
The third bail application has been filed now solely on the ground that
there is considerable delay in conclusion of the Trial Court and therefore the present Applicant who is in jail since 21.03.2014 may be released on bail. 4.
Considering the nature of the offence and allegation leveled against the present Applicant and the fact that this Court has already decided the case on merit on 06.04.2015, this Court does not find it a fit case for grant of bail to the present Applicant.
7.
Accordingly, the present bail application is dismissed. However, it is expected that the Court below shall take necessary steps for speedy disposal of the trial.
