1. Heard.
2. This is the Second Bail application under Section 439 of the Cr.P.C for grant of regular bail to the applicants who have been arrested in connection with Crime No. 54/2014 registered at Police Station Vidhan Sabha, Civil and Revenue District Raipur, C.G. for the offence under Section 379/34 of the Indian Penal Code.
3. Learned counsel for the applicants would submit that pursuant to one memorandum statement the applicants have been roped in 5 criminal cases, arising out of which, in three bail applications the Coordinate Bench has passed a common order in MCRC No. 1257 of 2018, 1261 of 2018 & 1273 of 2018 directing early conclusion of the trial within 4 months, while the applicant has been denied bail.
4. Learned counsel for the applicants would submit that he may be permitted to withdraw the bail application, however, the trial Court may be directed to decide the trial within the same period, as has been directed by the Coordinate Bench.
5. Prayer allowed.
6. The bail application is dismissed as withdrawn, however, the direction to conclude the trial, at the earliest preferably, within 4 months, passed in MCRC No. 1257 of 2018, 1261 of 2018 & 1273 of 2018 shall also apply for the present bail application.
