In this writ application, the challenge is to the denial of appointment on the post of Patwari by wrongly refusing to recognise the one year Diploma course qualification of the Petitioner as being from an unrecognised institution. It is further contended that persons with lesser marks have been appointed, but they have not been made party-Respondents.

Counter-affidavit has been filed on behalf of the Respondents copy of which was served on 12.11.2009. No rejoinder has been filed till date.

First paragraph of the counter-affidavit states as under: "It is respectfully submitted that the condition as laid down in Clause (A)(4) and (5) expressly requires that a candidate must have passed one year Diploma course in Computer Application from a Govt./Semi Govt. institution or a institution which is recognized by the Govt. of India and the State Government. The petitioner, in the instant case has undertaken a

computer course from an institution which is not recognized by the State Govt. and therefore, under the mandatory condition as stated in the Advertisement of Annexure P/1, he was denied opportunity for counseling."

The Court therefore finds no merit in the writ application. It is dismissed accordingly.
