Hon'ble Shri Justice Manindra Mohan Shrivastava & Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 19/03/2018 Heard.
2.
Though number of grounds have been urged in the appeal to assail the
correctness and validity of the order dated 12-12-2017 passed by the learned Single Judge in WP(227)No.7108/2010, in so far as the appeal filed by the present appellant Smt. Hans Kumari is concerned, in the light of authoritative pronouncement of the Full Bench of this Court in the case of High Court Bar Association Through its Secretary, Chhattisgarh v. State of Chhattisgarh and others, ILR 2016 Chhattisgarh 1, we are of the considered view that the statutory remedy of writ appeal is not available against the order passed by the learned Single Judge in exercise of supervisory jurisdiction under Article 227 of the Constitution of India. Therefore, for that reason only, we are inclined to dismiss the appeal as not maintainable.
3.
In the result, the writ appeal is dismissed as not maintainable. SD/- SD/- (Manindra Mohan Shrivastava) (Sharad Kumar Gupta) Judge Judge Tumane
