Hon'ble Justice Shri Gautam Chourdiya Order on Board 23/06/2021 1) The matter is heard through Video Conferencing. 2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 31/05/2020 in connection with Crime No. 153/2021 registered at Police Station Purani Basti, Raipur, District Raipur (C.G.) for the offence punishable under Section 307, 34 of the Indian Penal Code and Section 25 & 27 of Arms Act.

3) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

4) The First Bail Application of co-accused Rishi Thakur @ Gangadhar Thakur i.e. MCRC 6683/2020 was rejected on merits on 16/12/2020 and the Second Bail Application i.e. MCRC No. 1502/2021 was also rejected on merits on 25/02/2021 by the Co-ordinate Bench of this Court.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
