This application under Section 438 of the Code of Criminal Procedure has been filed by the applicant who is apprehending his arrest in connection with Crime No.185/2020 registered at Police Station - Suhela, District Balodabazar, Bhatapara (C.G.) for commission of the offence punishable under Section 34 (2) of Excise Act. 2.

Learned counsel for the applicant submits that the applicant has been arrested and, as such, the instant MCRC(A) has become infructuous.

Accordingly, the MCRC(A) No.212/2021 is dismissed as having become infructuous.
