1. The Labour Court passed an award dated 16-10-1999 deciding Reference Case No.5/MPIR Act/96 (General Secretary, Pragatisheel Engineering Shramik Sangh v. Niyojak, Bhilai Engineering Corporation) against which M/s. Bhilai Engineering Corporation filed W.P.No.5167/1999 as well as the Union filed W.P.No.76/2000. In the said reference, the present petitioner was employee. W.P.No.5167/1999 has been allowed in part whereas W.P.No.76/2000 has been dismissed completely.

2. Learned counsel for the petitioner submits that Reference

Case No.5/MPIR Act/96 was answered vide order dated 1610-1999 against which M/s. Bhilai Engineering Corporation preferred W.P.No.5167/1999 whereas Pragatisheel Engineering Shramik Sangh preferred W.P.No.76/2000 and by order dated 11-5-2016, the writ petition preferred by M/s. Bhilai Engineering Corporation has been partly allowed and the writ petition preferred by Pragatisheel Engineering Shramik Sangh has been dismissed. In the list of employees included in Pragatisheel Engineering Shramik Sangh, the petitioner herein was also employee therein. Therefore, this writ petition be disposed of in terms of the order dated 11-52016 passed in W.P.No.76/2000.

3. The prayer is fair and reasonable.

4. Accordingly, the writ petition is disposed of in terms of the order dated 11-5-2016 passed in W.P.No.76/2000. No order as to costs.

5. A copy of the order dated 11-5-2016 passed in W.P. No.76/2000 be made part of this order.
