Hon'ble Shri Justice P. Sam Koshy Order on Board 18.03.2021 .

1. The grievance of the petitioner in the present writ petition is the inaction on the part of the respondents in not deciding the claim for compassionate appointment of the petitioner on the death of the brother of the petitioner.

2. According to the petitioner, the brother of the petitioner in the present writ petition is said to have died in harness on 18.02.2018 working on the post of Assistant Teacher Panchayat.

3. Learned counsel for the State submits that since his application has till date not been rejected means that the same is under

-2consideration and the same shall be decided in accordance with law the scheme governing the field at the earliest.

4. Given the said facts, the respondents No. 4 to 6 are directed to take an appropriate decision on the claim of the petitioner after due verification of fact so far as his entitlement under the scheme is concerned at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
