(2) Learned counsel for the parties would jointly submit that since the order under challenge, terminating the service of the petitioner, is also assailed by the petitioner by filing an appeal under Section 35 of the Central Universities Act, 2008, before the Executive Council of University, the writ petition may be disposed of with a direction to the appellate authority to decide the appeal at the earliest.

Accordingly, the writ petition is disposed of with a direction that the Appellate Authority shall consider and decide the appeal preferred by the petitioner on its own merits in the first E.C. meeting after appointment of the regular Vice Chancellor.
