The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 198/2015 registered in Police Station Gandhinagar, Distt. Surguja (C.G.) for offence punishable under section 22 (B) of NDPS Act.

As per the prosecution case on 2/10/2015 at about 6.30 am the applicant and other co-accused while were trying to sell brown sugar they were apprehended and from the possession of the applicant 12 gms of brown sugar was seized.

Learned counsel for the applicant submits that from the joint possession of the applicant and other co-accused Prashant Vishwakarma the seizure was made and co-accused Prashant Vishwakarma have been enlarged on bail in M.Cr.C. No.7019/2015 on 16/12/2015, therefore the applicant may also be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the seizure memo. As per the seizure memo entire

seizure of the brown sugar of 12 gms was made from this applicant. Taking into account prima facie the fact that brown sugar was seized from this applicant, this court is not inclined to release the applicant on bail. 6.

Accordingly, the bail application is dismissed. Certified copy as per rules.
