The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.97/2015 registered in Police Station Kusmi District Balrampur-Ramanujganj (C.G.) for offence punishable under section 354, 506 of Indian Penal Code and Section 8 of Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case a report was made on 10/10/2015 that on 11/09/2015 when victim was coming from field, at that time the applicant caught hold of the prosecutrix and dragged her and thereafter placed his hand over the chest, thereby has tried to outrage the modesty of the victim.

Learned counsel for the applicant submits that becaues of the earlier land dispute, false report has been made. It is further stated that report is belated by one month and applicant has been falsely implicated in this case. He further submits that charge sheet has been, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Considering the facts and circumstances of the case, charge sheet having been filed and applicant is in jail since 10/10/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
