1. Petitioner-tenant has filed an undertaking before this Court that he will vacate the shop which he had taken on rent and handover peaceful possession to the respondent landlord on 31.12.2018 provided advance of Rs.1,00,000/- paid to the landlord in terms of the agreement dated 15.3.1999 is returned.

2. Today, a sum of Rs.1,00,000/- through Cheque No.973621 dated 4.12.2018 drawn on State Bank of India, Main Branch, Jagdalpur has been handed over to the counsel for the petitioner-tenant and in support thereof a photocopy of the cheque has been brought on record through a covering memo.

3. Petitioner-tenant also handed over a cheque of Rs.10,630/- dated 13.11.2018 drawn on Chhattisgarh Rajya Grahmin Bank, Branch Jagdalpur to the respondent landlord in presence of his counsel. This amount is supposed to be the payment of rent for the month of November & December, 2018 which was earlier returned when sent by post.

4. In view of the reconciliation so reached coupled with the undertaking given by the petitioner tenant, this writ application stands disposed off with a direction upon the petitioner tenant that he will handover vacant peaceful possession of the tenanted property, which is said to be a shop, on or before 31.12.2018, failure to do so may amount to contempt of the Court.
