This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicants have been arrested in connection with Crime No. 40/2019 registered at Police Station- Bemetara, District- Bemetara (C.G.) for the offence punishable under Section 34(2), of C.G. Excise Act 1915. 3.

Case of the prosecution, in brief is that on 23.01.2019 8.640 bulk liters of foreign liquor has been seized from the possession of the applicant No.1 Ramlal Ghritlahre. Applicant No.2 Lakhan Patre accompanied to him. 4.

Counsel for the State submits that there is no criminal antecedent of the applicants is reported in police case diary.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if each applicant furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of Rs. 25,000/- to the satisfaction of the trial Court concerned, they be released on bail. 6.
