(2) Learned counsel appearing for the petitioner submits that the petitioner is working as Class-IV employee. By the impugned transfer order dated 11.12.2015 (Annexure P/1) passed by respondent No.1-Secretary, Higher Education Department, Raipur, the petitioner has been transferred from Government Danveer Tula Ram College, Utai, District Durg to Government Naveen College Bhairamgarh, District Bijapur and he has been relieved from the present place on 31.12.2015. He further submits that he has not been paid salary for the last 09 months against

which, he has made representation before respondent No.1Secretary, Higher Education Department, Raipur, which has not been considered and decided till this date and therefore, he may be permitted to file fresh representation before the competent authority for redressal of his grievances and the same may be directed to be decided expeditiously.

(3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to file a fesh representation before the respondent No.1. If such representation is made by the petitioner within a week from today, respondent No.1 shall consider and decide the same on its own merit and in accordance with law preferably within a period of 30 days from the date of receipt of copy of this order/representation of the petitioner. (5) For a period of 45 days, the impugned order dated 11.12.2015 in respect of the petitioner shall remain stayed. (6) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
