1. The present contempt petition has been filed alleging non compliance of the order dated 17.09.2018 passed in WPS 6080 of 2018.
2. The direction for department was for considering the representation of the petitioner for regularization in accordance with the circular of the State Govt. dated 05.03.2008. The Counsel for the respondents have filed their reply wherein It has mentioned because of non availability of sanction vacant post. The claim of the petitioner for regularization could not be considered, Counsel for the respondents referring to the order dated 03.04.2019 submitted that the department has already taken steps for increasing the number of post of drivers.
3. Given the said submission that the respondents have made, it appears that if there would had been vacant post available, the department would have considered the case of the petitioner for
regularization subject to his fulfilling all the other requisite eligibility criteria.
4. On the said reply of the respondents, the present Contempt Petition stands disposed of.
5. Reserving the right of the petitioner to approach the Court, in case, if inspite of vacancies being available, the department does not consider the claim of the petitioner.
