(1) Learned counsel appearing for the petitioner would submit that petitioner's appeal is pending consideration before the Commissioner, Bastar Division, District Bastar and, therefore, the same may be directed to be decided within the specific time frame.

(2) Prayer appears to be fair & reasonable.

(3) Be that as it may, the Commissioner, Bastar Division is directed to decide the appeal of the petitioner, which is pending since 26.09.2011, expeditiously preferably within a period of three months after affording due opportunity of hearing to the parties. (4) With the aforesaid observations, the writ petition stands finally disposed of.

(5) This court has not expressed any opinion on the merits of the case and the appellate authority are free to decide the appeal on its own merit in accordance with law.
