This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 44/2015, registered at Police Station Antagarh, District North Bastar Kanker (C.G.), for

the offence punishable under Sections 457, 380 of IPC. 2.

Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the manner in which the applicant and ten accused persons entered into the house of complainant Jagat Ram Koudi on 02/09/2015 and stolen property worth Rs.50,000/- and consequent recovery from the applicant, I am not inclined to grant regular bail to the applicant.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected. However, the trial Court is directed to expedite the trial.
