1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.402/2019, registered at Police Station Saja (Chowki Devkar), Dist. Bemetara (CG) for the offence punishable under Sections 354 & 456 of the Indian Penal Code.

3. Applicant has allegedly molested the prosecutrix, who is none other than his Maternal Aunt (ममामम).

4. Learned counsel appearing for the State would oppose the bail application.

5. Considering the fact that the applicant is in jail since 9-12-2019 i.e. for more than 3 months and the offence is triable by Judicial Magistrate First Class, I am of the opinion that present is a fit case to release the applicant on regular bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
