Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 2 5/01/2016 Heard.

(1) Learned counsel appearing for the petitioner would submit that in his appeal preferred, the Director (Geology & Mining) has recommended the suspension to be

revoked but the State Government has not considered the case of petitioner in light of recommendation made by Director (Geology & Mining) and, therefore, a direction may be issued to the State Government to consider the case of petitioner afresh in light of recommendation made by the Director, Directorate of Geology & Mining and the same may be directed to be decided expeditiously.

(2) Prayer appears to be fair & reasonable.

(3) Be that as it may, respondents authorities are directed to consider petitioner's case afresh in light of recommendation made by Director (Geology & Mining) for suspension to be revoked expeditiously preferably within a period of 45 days from the date of receipt of copy of this order.

(4) With the aforesaid observations, the writ petition is finally disposed of.

(5) It is made clear that this Court has not expressed any opinion on the merits of the case and the authority concerned shall decide the case of the petitioner on its own merits in accordance with law.
