(2) Learned counsel appearing for the petitioner submits that the petitioner is working as Upper Division Teacher, who has been transferred from Government Middle School, Arand, Block Pithora, District Mahasamund to Government Middle School, Sohagpur by the impugned transfer order dated 03.09.2015 (Annexure P/1) passed by respondent No.3-District Education Officer, Mahasamund, against which, he has made
representation before respondent No.3, which has not been considered and decided till this date and therefore, he may be permitted to file fresh representation before respondent No.2Collector, Mahasamund for redressal of his grievances and direction may be issued to the said authority to decide the same expeditiously.
(3) Prayer appears to be fair and reasonable.
(4) The petitioner is permitted to file a fresh representation before the respondent No.2-Collector, Mahasamund. If such representation is made by the petitioner within 15 days from today and, in turn, respondent No.2 shall consider and decide the same on its own merit and in accordance with law preferably within a period of 45 days from the date of receipt of representation of the petitioner.
(5) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
