The only issue arising for consideration in this petition is, as to whether the petitioner is entitled to interest on belated payment of GPF amount. No return has been filed by the State for the last five years. It is a case of pensioner. Grievance of the petitioner is that though the petitioner was retired on 31-03-2005, GPF was paid after five years in the month of January, 2010. There is nothing on record to show that the petitioner himself was responsible for delay in payment of GPF. Therefore, in these circumstances, the petitioner is entitled for appropriate interest on the amount of GPF from the date if became due till the date it was actually paid. 3.

Considering the totality of the circumstances, it is directed that the respondents shall pay interest @ 18% on the amount of GPF from the date it became due for

payment i.e. the date of retirement till the date of actual payment. 4.
