Hon'ble Shri Justice Pritinker Diwaker Order On Board 20/01/2016 Counsel for the applicant submits that the appellate court has erred in law in directing the applicants to file the memo of appeal in a proper format. He submits that the memo of appeal (Annexure P-3) is in accordance with law and therefore there is no infirmity in the same. He further submits that purpose of filing this revision would be served if direction is issued to the appellate court below for deciding the pending appeal filed by the applicants within the time frame.

State counsel has no objection if any such direction is issued to the appellate court.

Considering the facts and circumstances of the case, the appellate court is directed to decide the pending appeal of the applicants as expeditiously as possible preferably within a period of one month from the date of receipt of copy of this order subject to cooperation from the counsel for the applicants.

It is made clear that this Court has not expressed any opinion on the merits of the case and the appellate court to decide the appeal in accordance with law.
