Hon'ble Shri Justice P. Sam Koshy Order on Board 21.02.2019
1. The present review petition has been filed seeking review of the order dated 16.01.2019 passed by this court in WPS No.272 of 2019. The relief sought for by the petitioner in the writ petition was for a direction to the respondents to consider grant of maternity leave.
2. During hearing in the review petition, learned counsel for the petitioner submits that the petitioner has infact received the entire maternity leave that is available under the rules i.e. 180 days. He further submits that in addition to 180 days, the petitioner has also applied for child care leave for a period of 161 days as per circular of the State Govt. dated 04.10.2018.
3. Since the petitioner has got entire maternity leave as was applicable under the rules and as regards the child care leave for which the petitioner has applied, and the same being pending consideration before the authorities
concerned, the present review petition stands disposed of with a direction that disposal of WPS NO. 272 of 2019 should not come in the way of the respondents in deciding the application of the petitioner seeking child care leave in accordance with circular dated 04.10.2018.
4. With the aforesaid observations, the review petition stands disposed of. It is expected that the respondent authorities would take a decision on the claim of the petitioner at the earliest.
