1. The report of the Collector has been received which shows that Applicant Rabiya Begum does not possess any landed property. It is also proved that she is living with her niece (daughter of her sister). She is also registered under the Antyoday Scheme which shows that she belongs to the poorest section of the society. She is only getting old age pension of Rs.300/- per month and as such she is not in a position to pay the Court-fee. Therefore, she is declared as an indigent person and is permitted to prosecute the case as an indigent person.

Accordingly, the M.C.C. is allowed.

A copy of this order be placed on the record of First Appeal No.147 of 2003.
