Learned counsel for the petitioner would submit that the petitioner though have been granted time bound pay scale from 13/10/2007, however same benefit has not been given to him and the fixation of time bound pay scale with the arrears has not been paid and the benefit is to be given by respondent No.4. He submits that endorsement has already been made by respondent No.3, Executive Engineer, PWD as per Annexure P-4. Consequently, the benefit eventually has to be accorded by the respondent No.4. He submits that already representation been made to respondent No.3 which may be directed to be decided alongwith the concurrence of the respondent No.4.

Considering the fact and perusal of Annexure P-4 would show that
the entry has been made to grant time bound pay scale to the petitioner. Consequently, at this stage considering the prayer of the petitioner, respondents No.3 & 4 are directed to decide the representation of the petitioner within a period of 60 days. Meaning thereby the respondent No.3 shall forward the entire case of the petitioner within a period of 30 days from the date of receipt of this order to the respondent No.4, thereafter the respondent No.4 shall decide the representation of the petitioner within a further period of 30 days. If arrears are payable to the petitioner that shall be granted.
